<p class="">Hiring a private investigator is a serious decision, almost always made during challenging or stressful times. When you want to ensure that the investigator you hire is capable of delivering reliable and admissible evidence. However, something we see many investigators talking about, but very few NON-investigators talking about, is whats the client&#8217;s job once a PI has been hired. So! Today we&#8217;re going to have a quick chat about what roles the client has to play after hiring a PI. </p>



<h4 class="wp-block-heading" id="h-1-avoid-confronting-the-subject-of-the-investigation">1. Avoid Confronting The Subject Of The Investigation</h4>



<p class="">As already stated, those in search of a private investigator are typically already under a significant amount of stress. This is particularly true for those needing help with a personal matter. With emotions charged and so much happening at once, it can be hard to plan your next steps. Unfortunately, one of the paths we see people take the most often is the path of confrontation. Oftentimes, the Need-To-Know combines with the hope that there may be a perfectly reasonable explanation for what&#8217;s been discovered. On the positive side, we have client&#8217;s who will approach the issue head on eager to hear a simple explanation to ease their minds. More negatively, a client may already be sure they know what&#8217;s going on and confront immediately, <em>demanding</em> an explanation. </p>



<p class="">More than once, we&#8217;ve even had clients tell us that they threatened the second subject with hiring a PI who would get proof that someone was lying! Here&#8217;s the thing; and we can&#8217;t stress this enough&#8230;don&#8217;t do this. Even though the urge to confront can feel overwhelming, it is and almost always will be, self harming. When a client gives in to the urge to confront, more often than not what we see is any evidence that was there to find, suddenly disappears. Many refer to this as &#8220;going-underground&#8221;. Simply put, a subject that would have been fairly oblivious and easy to investigate, is now aware they&#8217;re being investigated and is actively taking pains to hide their activities. </p>



<h4 class="wp-block-heading" id="h-2-avoid-drawing-unnecessary-attention">2. Avoid Drawing Unnecessary Attention</h4>



<p class="">Discretion is key in private investigation. This goes for both the investigator AND the client. While you don&#8217;t want to directly confront the subject of your investigation, if possible, also avoid withdrawing. Obviously, this can be quite difficult, and for some situations and people more than others. But ideally, during the course of the investigation clients should strive to keep their cards as close to the vest as possible. Maintain your regular habits and activities or, if that&#8217;s not possible, have a solid excuse for why you can&#8217;t. </p>



<h4 class="wp-block-heading" id="h-3-avoid-engaging-in-illegal-activities">3. Avoid Engaging In Illegal Activities</h4>



<p class="">This is one of the best possible reasons to hire a private investigator. Over the course of any investigation, you&#8217;ll almost inevitably run up against an idea or a plan which may run afoul of the law. Placing a tracker on a vehicle for example, is an easy enough activity that may very well get some answers. Why hire a PI when an Apple Airtag costs less than a tank of gas and can be purchased on Amazon? Because more often than not, use of an Airtag, or any other tracker used like this, is illegal. </p>



<p class="">The best case scenario is that your evidence will be tossed out. The worst case scenario may end with you facing significant legal consequences. And this trend continues across virtually all avenues of an investigation. The average person, no matter how intelligent, may run afoul of the law when they choose to investigate independently.  </p>



<h4 class="wp-block-heading" id="h-4-avoid-making-assumptions">4. Avoid Making Assumptions</h4>



<p class="">Solid evidence is king, not assumptions or guesses. Anyone, either an investigator or a client, jumping to conclusions without corroborating their findings, can lead to incorrect or biased reports. Make sure your investigation is thorough and bases conclusions on verified information.</p>



<h4 class="wp-block-heading" id="h-5-avoid-relying-on-a-single-source">5. Avoid Relying on a Single Source</h4>



<p class="">Relying solely on one source of information may provide incomplete or misleading results. A reliable investigator will cross-check details from multiple sources to ensure accuracy, giving you a more comprehensive understanding of the situation. As a client, hiring a PI will give you one additional unbiased source to find or confirm information, who in turn has even more information sources of their own. </p>



<h4 class="wp-block-heading" id="h-6-avoid-sharing-the-secret">6. Avoid Sharing the Secret</h4>



<p class="">Confidentiality is critical in private investigations, the more people who know what is happening, the greater the odds that the subject being investigated finds out they&#8217;ve been caught. People who know they&#8217;re caught become unpredictable and tend to being hiding or destroying valuable evidence. Benjamin Franklin famously said, &#8220;Three people can keep a secret, if two of them are dead&#8221;. He was right. </p>



<h4 class="wp-block-heading" id="h-8-avoid-interfering-with-the-investigation">8. Avoid Interfering with the Investigation</h4>



<p class="">Perhaps the best part of hiring a PI is you now have a professional to do the heavy lifting for you. Put differently, the investigator is now going to do most or all of the work. Emphasis on the <em>most or all</em> part. We once realized a client had hired us to surveil a subject, which was perfect, we were eager to help. We later also realized that same client had shown up on site in secret and was also following the subject in question, then asking what the investigators were doing or not doing certain things. This is less perfect&#8230;.much less perfect. </p>



<h4 class="wp-block-heading" id="h-final-thoughts">Final Thoughts</h4>



<p class="">Choosing the right private investigator is essential to getting the evidence you need while protecting your interests. Letting the investigator do the job you&#8217;ve hired them to do is just as essential. Waiting for an investigation to conclude can be as difficult as it is essential. However, by letting the investigation play out in it&#8217;s own time and cooperating with the investigator, you can ensure the highest odds of getting a successful outcome for your case. </p>

<p class="">There are plenty of reasons why you should hire a private investigator instead of trying to get answers yourself. For example, what exactly is the difference between stalking someone and hiring a private investigator to conduct an investigation? </p>



<h3 class="wp-block-heading" id="h-defining-stalking"><strong>Defining Stalking</strong></h3>



<p class="">Stalking is a form of harassment involving repeated and unwanted attention, contact, or any other behavior that causes a person to feel fear or distress. It can manifest in various ways, including:</p>



<ul class="wp-block-list">
<li class=""><strong>Following the victim:</strong> This can be physical, such as following someone, or virtual, such as tracking someone’s online activities.</li>



<li class=""><strong>Unwanted communication:</strong> This includes repeated phone calls, text messages, emails, or social media contact.</li>

Consequently, one of the key takeaways here is that stalking violates the victims personal privacy and causes them to feel fear or distress <em>in real time.</em> As in, the person is aware they are being followed and the person following them is refusing to leave them alone. Once though the victim is aware of the stalkers presence, you&#8217;re crossing into stalking territory. </p>

<p class="">Private investigators (PIs) are professionals hired to gather information and conduct surveillance for legitimate purposes. Their activities are bound by legal and ethical guidelines designed to protect the privacy and rights of individuals, and are controlled by continuous education requirements and training throughout the year. Key aspects of a PI’s role include:</p>

After all, if private investigations were illegal and so is stalking, how can you possibly hope to support your case in court? Or defend yourself from others who may be looking to take advantage of you for their own gain? Without a legal means to confirm and obtain information, any legal action taken against you or anyone else would almost inevitably devolve into a &#8220;he-said/she-said&#8221; type of argument with no real way for either side to advance their cause. Private investigators offer a solution to entities and individuals looking to protect themselves legally while also ensuring they don&#8217;t accidentally get themselves in more trouble legally. </p>

<p class="">Identifying potential workers&#8217; compensation fraud involves recognizing certain red flags or indicators that may suggest fraudulent activity. Here are some common indicators of workers&#8217; comp fraud in progress:</p>



<h3 class="wp-block-heading">1. <strong>Delay in Reporting the Injury</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The employee delays reporting the injury.</li>



<li class=""><strong>Reason</strong>: Genuine injuries are typically reported immediately, after all, you just got hurt. Don&#8217;t you want to go see a doctor? Delays may indicate the injury did not occur at work. This type of behavior is also frequently seen as a last ditch effort to secure additional money from an employer once they realize they may be facing disciplinary measures for an unrelated problem. For example, an employee who is about to be fired for missing a significant about of work may suddenly turn up with a back injury they sustained at work. This injury will now force them to A) miss any additional work they were scheduled for and B) Cost untold thousands of dollars, as will continue to receive a large amount of their average paycheck while their claim is investigated. This process may take years.</li>
</ul>



<h3 class="wp-block-heading">2. <strong>Lack of Witnesses</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: No witnesses to the injury, especially when it occurred in a normally populated area.</li>



<li class=""><strong>Reason</strong>: A lack of witnesses may suggest the injury happened outside of work. Consequently, this also has the fringe benefit of turning their case into a &#8220;He said-She said&#8221; argument, especially if there are no cameras in the area. </li>
</ul>



<h3 class="wp-block-heading">3. <strong>Conflicting Descriptions</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The description of the incident varies between the employee, medical provider, and employer.</li>



<li class=""><strong>Reason</strong>: Inconsistent accounts can indicate a fabricated or exaggerated injury. Like many deceptions, if the employee in question is in fact attempting to file a fraudulent claim, their lie will likely need to evolve throughout the investigation as various parties point out the flaws in the original lie. A doctor will likely ask questions a supervisor wouldn&#8217;t know to ask. An attorney will ask questions neither the doctor nor the supervisor asked. And an investigator will ask questions no one thought to ask.</li>
</ul>



<h3 class="wp-block-heading">4. <strong>History of Claims</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The employee has a history of filing multiple workers&#8217; comp claims.</li>



<li class=""><strong>Reason</strong>: A pattern of claims can be a strong indicator of fraudulent activity. Believe it or not, filing fraudulent claims is in fact a profession in and of itself for some people. These cases will also often be the most difficult to deal with, as these subjects know the system and are skilled at evading many of the most common red flags that signal employers to take a closer look. </li>
</ul>



<h3 class="wp-block-heading">5. <strong>Unusual Circumstances</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The injury occurs immediately before or after a weekend, holiday, or vacation.</li>



<li class=""><strong>Reason</strong>: Timing may suggest the injury occurred during personal time and not at work.</li>
</ul>



<h3 class="wp-block-heading">6. <strong>Reluctance to Cooperate</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The employee is reluctant to provide details about the injury or undergo a medical examination.</li>



<li class=""><strong>Reason</strong>: Lack of cooperation can be a tactic to avoid revealing inconsistencies or the true nature of the injury. Refusing to set doctors appointments or setting appointments and them missing them is a common delaying tactic. Again, the employee will continue to receive benefits during this time whether they make the appointment or not, and rescheduling certain appointments can take months before the next appointment is available. On a personal note, if I had a dollar for every time I&#8217;ve seen an employee miss an appointment because &#8220;they got stuck in traffic&#8221; while I&#8217;m actively watching them lounge on a beach somewhere, I&#8217;d be retired and sitting on a beach myself. </li>
</ul>



<h3 class="wp-block-heading">7. <strong>Overly Detailed or Vague Description</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The injury description is either excessively detailed or extremely vague.</li>



<li class=""><strong>Reason</strong>: An overly detailed story may be rehearsed, while a vague description might be a sign of fabrication. The truth is the truth, you shouldn&#8217;t have to think about it. Details that come and go with each retelling is never a good sign. </li>
</ul>



<h3 class="wp-block-heading">8. <strong>Discrepancies in Medical Records</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: Medical records show discrepancies or do not support the severity of the claimed injury.</li>



<li class=""><strong>Reason</strong>: Inconsistent medical documentation can indicate that the injury is exaggerated or non-existent.</li>
</ul>



<h3 class="wp-block-heading">9. <strong>Employee Behavior</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The employee is observed engaging in activities inconsistent with the reported injury.</li>



<li class=""><strong>Reason</strong>: This suggests the injury is not as severe as claimed or may be entirely fabricated. Some injuries are entirely real when they&#8217;re reported, and the lie comes afterwards. This is known as malingering, or in layman terms, they were hurt but it got better. While the employee reported an honest injury initially, it has since healed and in the meal time the employee is perhaps realizing that getting paid a significant portion of their regular paycheck while not having to work is a pretty good gig! Depending on the employee, reactions to this realization may range from getting paid to stay home and play video games, all the way to going out and acquiring a second job, thus receiving two incomes from performing only one role (double-dipping). </li>
</ul>



<h3 class="wp-block-heading">10. <strong>Financial Difficulties</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The employee is experiencing financial problems or has significant debts.</li>



<li class=""><strong>Reason</strong>: Financial stress can motivate an individual to commit fraud for financial gain. Being on workers comp means a guaranteed check in the mail even if you&#8217;re not going to work. As discussed above, some employees use this as an opportunity to acquire a second job and effectively double their income without working 90 hrs a week. </li>
</ul>



<h3 class="wp-block-heading">11. <strong>Employment Issues</strong></h3>



<ul class="wp-block-list">
<li class=""><strong>Red Flag</strong>: The employee is facing disciplinary action, demotion, or layoff.</li>



<li class=""><strong>Reason</strong>: An impending job issue can prompt an employee to file a fraudulent claim as a means of retaliation or financial security. This tactic keeps the money rolling in long after the employee was scheduled to be dismissed, and is an effective means of punishing an employer for a dismissal the employee feels was unjust. It may also be a delaying tactic, giving the employee paid time to look for new work, or sometimes just not work at all while still receiving a paycheck.</li>
</ul>



<h3 class="wp-block-heading">12. <strong>Excessive Treatment</strong></h3>



<ul class="wp-block-list">
